Terms of Service

These Terms of Service ("Terms") govern your use of the TrailSpark mobile application and the trailspark.com website (collectively, the "Service"), operated by TrailSpark ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 16 years old to use the Service. By using TrailSpark, you represent that you meet this age requirement.
2. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Use of the Service
TrailSpark generates route suggestions based on publicly available map data (OpenStreetMap), elevation models, and your personal preferences. Routes are algorithmically generated suggestions — not verified, surveyed, or guaranteed trails.
You acknowledge and agree that:
- Routes may pass through terrain that is dangerous, inaccessible, on private property, or otherwise unsuitable.
- Trail conditions, weather, closures, and hazards can change at any time and may differ from what is shown in the app.
- GPS data, elevation profiles, distance measurements, and navigation instructions are approximate and may contain errors.
- You are solely responsible for assessing conditions on the ground and making safe decisions during any outdoor activity.
- You should always carry appropriate equipment, inform others of your plans, and check local regulations before heading out.
4. Assumption of risk
Outdoor activities such as hiking, trail running, and cycling carry inherent risks including but not limited to injury, illness, property damage, and death. By using TrailSpark to plan or navigate outdoor activities, you voluntarily assume all risks associated with those activities, whether or not the route was generated by the Service.
5. User content
You retain ownership of all content you create through the Service, including routes, activities, and reviews. By making content public (e.g., sharing a route or publishing an activity), you grant TrailSpark a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content within the Service. You may revoke this license at any time by deleting the content or making it private.
You agree not to upload content that is illegal, infringes on third-party rights, or contains malware.
6. Third-party services
The Service integrates with third-party providers including MapTiler (map tiles), Garmin Connect (course sync), and OpenStreetMap (map data). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
7. Intellectual property
The TrailSpark name, logo, and application design are our property. The route generation algorithms, user interface, and original content are protected by copyright. You may not copy, modify, reverse-engineer, or distribute any part of the Service without our prior written consent.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that routes generated will be safe or suitable for any purpose.
9. Limitation of liability
To the maximum extent permitted by applicable law, TrailSpark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. This includes, without limitation, damages arising from following routes generated by the Service.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless TrailSpark and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your outdoor activities undertaken in connection with routes generated by the Service.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (limitation of liability, indemnification, governing law) will remain in effect.
12. Governing law
These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Belgium.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
